General conditions of use
Welcome to the "www.bialetti.it" website, the official online store of Bialetti Industrie S.p.A (hereinafter "Site"). The Site is managed and maintained by Triboo Digitale S.r.l. with registered office in Viale Sarca, 336 - 20126 Milan, Italy, tax identification number, VAT number and registration number in the Milan Business Register 02912880966 (hereinafter "TD").
Access to and use of the Site are governed by these General Terms and Conditions of Use (hereinafter "General Conditions"). Access to and use of the Site, as well as the purchase of products, presuppose the reading, knowledge and acceptance of these General Conditions and of the general conditions of sale.
If you do not agree, in whole or in part, with the General Conditions of the Site, please do not use our website.
Anyone accessing and using the Site implicitly declares not to use the Site for illicit purposes or in any case contrary to the laws in force.
TD may modify or simply update these General Conditions, in whole or in part. Changes and updates to the General Conditions will be notified to users on the Homepage of the Site as soon as they are on and will be binding as soon as they are published on the Website in this section.
If a clause of these General Terms and Conditions of Use is judged to be illegal, nothing or for any reason ineffective, its invalidity or ineffectiveness will not affect the validity or effectiveness of the remaining provisions.
2. Site Content
Access to and use of the Site, including the display of web pages, communication with TD, the ability to download product information and the purchase of the same on the website, are activities conducted by our users exclusively for extraneous personal purposes to any commercial, entrepreneurial and professional activity.
3. Limitation of Liability
By accessing the Website you will be the one and only responsible for the use of the same and its contents. TD, in fact, cannot be held liable for any use of its users that is not compliant with the laws in force on the Site and its contents, without prejudice to TD's liability for fraud and gross negligence. In particular, you will be the one and only responsible for the communication of incorrect and false information and data relating to third parties, without these having given their consent, as well as in consideration of an incorrect use of the same.
Finally, since each material will be downloaded or obtained through the use of the service at the user's choice and risk, all responsibility for any damage to computer systems or loss of data resulting from the unloading operations falls on the user and cannot be attributed to TD. TD disclaims any responsibility for any damage resulting from inaccessibility to the services on the Site or from any damage caused by viruses, damaged files, errors, omissions, service interruptions, deletion of contents, problems connected to the network, to providers or telephone links/or telematics, to unauthorized access, alteration of data, failure and/or faulty operation of the user's electronic equipment.
The user is responsible for the safekeeping and correct use of his personal information, including the credentials that allow access to the reserved services, as well as for any harmful consequence or prejudice that may derive from TD or third parties as a result of the incorrect use, loss or theft of such information.
5. Intellectual property rights
All content, in any format, published on the Site, including web pages, graphics, colors, patterns, tools, fonts and website design, diagrams, layouts, methods, processes, the functions and software that are part of the Site are protected by copyright and by any other intellectual property right of Bialetti Industrie SpA and of TD and other rights holders. The reproduction, in whole or in part, in any form, of the Site and its contents is prohibited, without the express written consent of Bialetti Industrie SpA and TD. Bialetti Industrie S.p.A and TD have the exclusive right to authorize or prohibit the direct or indirect, temporary or permanent reproduction, in any way or form, in whole or in part, of the Site and its contents. With regard to the use of the Site, you are only authorized to:
(i) display the website and its contents;
(ii) perform all those other temporary acts of reproduction, without their own economic importance, which are considered transitory or ancillary, an integral and essential part of the visualization of the site and its contents;
(iii) all other navigation operations on the website that are performed only for a legitimate use of the same and its contents.
Any further reproduction must be authorized from time to time by Bialetti Industrie SpA and TD or, if necessary, by the authors of the individual works contained on the website. These reproduction operations must in any case be performed for lawful purposes and in compliance with the copyright and other intellectual property rights of Bialetti Industrie SpA and of TD and of the authors of the individual works contained in the website. The authors of individual works published on the Site have, at any time, the right to claim authorship of their works and to oppose any deformation, mutilation or other modification of the works themselves, including any damage caused to the works, which is prejudicial to their honor or reputation. You agree to respect the copyright of the artists who have chosen to publish their works on the Site or who have collaborated with the latter in creating new expressive and artistic forms destined to be published, even if not exclusively on the website, or, again, which form an integral part of it. Furthermore, you are not, under any circumstances, authorized to use, in any way or form, the contents of the website and every single work protected by copyright and by any other intellectual property right. By way of example, you will not be able to alter or otherwise modify the protected contents and works without the consent of Bialetti Industrie S.p.A and TD and, where necessary, of the individual authors of the works published on the Site.6. These General Conditions are governed by Italian law and interpreted pursuant to the same, including, by way of example but not limited to, any dispute concerning the existence, validity and effectiveness of the General Conditions and any other agreements that they make referral.
If you are a consumer, please refer to the legislative decree 6 September 2005, n. 206, bearing the "Consumer Code", and subsequent additions and amendments.
